Terms of Service

For the purposes of these Terms:

VEWRS is a fan engagement, attendance verification, loyalty, and sports intelligence platform. The primary purpose of the Platform is to recognise, measure, enhance, and reward participation in sport and entertainment experiences.

The Platform enables users to:

• verify attendance at eligible events;
• participate in fan engagement activities;
• build loyalty and status;
• access content and experiences;
• engage with rewards programs;
• participate in promotional campaigns;
• receive fan-related insights and benefits.

Reward Entries are incidental promotional benefits that may be allocated in connection with participation in the Platform. Reward Entries are not the primary purpose of the Platform, any Subscription Plan, or any Platform feature.

VEWRS is not:

• a gambling service;
• a wagering operator;
• a betting service;
• a lottery operator;
• a gaming provider;
• a financial product provider.

Users do not purchase Reward Entries or purchase chances to win prizes through the Platform. Participation in VEWRS does not guarantee any reward, prize, experience, benefit, or promotional outcome.

To access certain features, you may be required to create an account.

You agree to:

• provide accurate and complete information;
• maintain the security of your login credentials;
• keep your information up to date;
• notify us immediately of any unauthorised use of your account.

You are responsible for all activity occurring under your account. VEWRS may suspend, restrict, or terminate accounts where fraud, misuse, unauthorised access, or breaches of these Terms are suspected.

Certain Platform features may require location services to verify attendance at live events. Location services are optional. However, if location permissions are disabled, certain features including attendance verification, event check-ins, attendance-based rewards, status progression, or related functionality may be unavailable.

By enabling location services, you consent to VEWRS collecting and processing location information solely for purposes related to attendance verification, fraud prevention, service functionality, and Platform improvement.

VEWRS does not guarantee successful attendance verification in all circumstances. Verification outcomes may depend on factors including:

• device settings;
• connectivity;
• venue conditions;
• third-party systems;
• technical limitations.

VEWRS reserves the right to determine, investigate, validate, reject, or reverse attendance verification outcomes where fraud, error, or misuse is suspected.

Reward Entries may be allocated based on:

• verified attendance;
• participation in platform activities;
• engagement activity;
• achievement of loyalty milestones;
• status progression;
• promotional campaigns;
• participation multipliers;
• other eligibility criteria determined by VEWRS.

VEWRS makes certain engagement, loyalty, and promotional opportunities available to eligible users regardless of whether they hold a paid Subscription Plan.

Reward Entries:

• are promotional in nature;
• are non-transferable;
• are not redeemable for cash;
• do not constitute property;
• have no guaranteed monetary value;
• may expire where specified.

Allocation of Reward Entries does not guarantee any prize, benefit, or promotional outcome. Where reward entries are used to determine eligibility for a giveaway or promotional draw:

• entries may be earned through eligible participation and engagement activities;
• entries cannot be purchased directly;
• winners will be selected using a fair and random process where applicable;
• promotional activities will be conducted in accordance with applicable laws.

VEWRS reserves the right to invalidate entries obtained through fraud, manipulation, abuse, technical exploitation, or violations of these Terms.

VEWRS maintains the right to investigate any activity affecting the integrity of:

• attendance verification;
• reward entries;
• status systems;
• promotional activities;
• Experience Rewards.

VEWRS may suspend, reverse, remove, invalidate, or adjust reward entries, status levels, achievements, rewards, and attendance records where fraud, manipulation, abuse, technical exploitation, duplicate accounts, automated activity, or suspicious conduct is identified.

VEWRS' determination regarding verification outcomes and Platform integrity matters shall be final unless otherwise required by law.

VEWRS may conduct promotions, competitions, giveaways, prize draws, and similar promotional campaigns from time to time. Such promotions may be governed by separate Promotional Rules. Where separate Promotional Rules apply, those rules form part of these Terms.

Unless otherwise specified, winners will be selected through a fair and random process. VEWRS reserves the right to verify eligibility, investigate irregularities, invalidate entries, and disqualify participants where fraud, abuse, manipulation, or breaches of these Terms are identified.

VEWRS may offer both free and paid Subscription Plans. Subscription Plans are offered to enhance the user experience through additional Platform functionality, premium content, loyalty benefits, fan engagement features, community experiences, and partner benefits.

Subscription Plans may include:

• exclusive content;
• enhanced attendance insights;
• advanced fan analytics;
• premium experiences;
• loyalty accelerators;
• enhanced Status progression;
• priority access opportunities;
• partner offers;
• additional Platform functionality.

Certain Subscription Plans may also provide participation multipliers or loyalty benefits that may influence the allocation of Reward Entries. Any promotional benefits associated with a Subscription Plan are secondary and incidental to the primary purpose of the Subscription Plan. Users do not purchase Reward Entries, chances to win prizes, or promotional outcomes through a Subscription Plan.

Subscription fees are paid solely for access to Platform services, functionality, content, and benefits. Subscription fees, billing frequencies, renewal arrangements, and cancellation rights will be disclosed at the time of purchase.

Subscriptions purchased through the Apple App Store or Google Play Store may be governed by additional marketplace terms. Users are responsible for managing subscription renewals through the applicable marketplace where required.

You agree not to:

• violate any applicable law;
• interfere with Platform operations;
• attempt to gain unauthorised access to systems or accounts;
• impersonate another person;
• create multiple accounts for abusive purposes;
• manipulate rewards systems;
• exploit software vulnerabilities;
• reverse engineer Platform technology;
• use automated systems, bots, scripts, scrapers, or similar technologies without written permission;
• engage in fraudulent attendance verification activities.

VEWRS may investigate and take action against any conduct that threatens Platform integrity or user safety.

VEWRS may introduce:

• public profiles;
• leaderboards;
• rankings;
• social engagement features;
• community participation tools.

Users acknowledge that information they choose to make public may become visible to other users. VEWRS reserves the right to moderate, remove, restrict, or manage public content to maintain Platform integrity and user safety.

The Platform and all associated intellectual property rights remain the exclusive property of VEWRS Pty Ltd and its licensors. This includes:

• software;
• algorithms;
• trademarks;
• logos;
• branding;
• graphics;
• designs;
• databases;
• reward systems;
• verification systems;
• content;
• Platform functionality.

Nothing in these Terms transfers ownership of any intellectual property rights to users. You may not reproduce, modify, distribute, commercialise, copy, or exploit any part of the Platform without prior written consent.

VEWRS aims to provide a reliable service but does not guarantee uninterrupted availability. The Platform may experience:

• maintenance;
• outages;
• delays;
• interruptions;
• technical failures;
• third-party service disruptions.

VEWRS may modify, suspend, discontinue, or update any part of the Platform at any time without liability.

VEWRS may suspend, restrict, or terminate your access to the Platform immediately where:

• you breach these Terms;
• fraud is suspected;
• unlawful activity is suspected;
• Platform integrity is threatened;
• required by law.

You may cease using the Platform and close your account at any time. Termination does not affect accrued rights, obligations, or liabilities existing before termination.

Users may request deletion of their account at any time. Following account deletion:

• access to the Platform may cease;
• rewards may be forfeited;
• Status records may be removed;
• Reward Entries may be cancelled.

VEWRS may retain information where required:

• by law;
• for legitimate business purposes;
• for fraud prevention;
• for dispute resolution;
• for regulatory compliance.

Data handling practices are further described in the Privacy Policy.

To the maximum extent permitted by law, the Platform is provided on an "as is" and "as available" basis.

VEWRS does not warrant that:

• the Platform will always be available;
• the Platform will be error-free;
• attendance verification will always succeed;
• rewards will always be available;
• any particular outcome, benefit, or result will be achieved through use of the Platform.

Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

To the maximum extent permitted by law, VEWRS, its officers, directors, employees, contractors, affiliates, licensors, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from:

• use of the Platform;
• inability to use the Platform;
• loss of rewards;
• loss of data;
• loss of opportunities;
• third-party services;
• attendance verification outcomes;
• promotional activities.

Where liability cannot be excluded, VEWRS' liability is limited to the minimum extent permitted by law.

You agree to indemnify and hold harmless VEWRS and its affiliates from claims, liabilities, damages, losses, costs, and expenses arising from:

• your use of the Platform;
• your breach of these Terms;
• your violation of applicable laws;
• your misuse of Platform features.

VEWRS continually evolves and improves its services. Accordingly, VEWRS may:

• modify Platform features;
• introduce new functionality;
• discontinue services;
• alter rewards systems;
• adjust verification methods;
• restructure Subscription Plans.

VEWRS will endeavour to provide reasonable notice where material changes are expected to significantly affect users.

VEWRS shall not be liable for delays, interruptions, failures, or inability to perform obligations arising from circumstances beyond its reasonable control. This includes:

• natural disasters;
• pandemics;
• government actions;
• venue closures;
• sporting event cancellations;
• telecommunications failures;
• internet outages;
• cyber incidents;
• third-party service interruptions;
• acts of God.

Users acknowledge that:

• Apple Inc. and Google LLC are not responsible for the Platform;
• marketplace operators have no obligation to provide support for the Platform;
• marketplace operators are third-party beneficiaries of these Terms where applicable.

Any rights relating to application marketplaces remain subject to the terms of the applicable marketplace.
